Digital Image License



Client's Usage

The Customer shall only use the digital files ("digital image", "media") in accordance with the permissions within this agreement. The Customer's digital files are for commercial use in accordance with the expressly written licensing set forth below. Digital files shall not be submitted to contests, reproduced for commercial use not permitted in this license without prior consent by The Nightmare & The Nightbird, or reproduced in any way by parties other than The Nightmare & The Nightbird.


The Nightmare & The Nightbird grants the Customer a non-exclusive, non-transferable, perpetual, commercial-use license that shall only be used in accordance with the expressly written licensing agreement set forth below. Title and ownership, and all rights now and in the future, of and for the media remain exclusively with The Nightmare & The Nighbird. There are no warranties, express or implied. The media is provided "as is".



Social Media

The Customer may share blog post links and Facebook albums through use of the share functions and dissemination of direct links. All images posted on social media may require a direct link or credit towards The Nightmare & The Nightbird. The Customer shall not copy, download, screenshot, or capture the photographs in any other fashion. The Customer also shall not significantly crop, edit, or add filters to any photographs without prior consent by The Nightmare & The Nightbird.



Permitted Uses

Commercial Use:

  • Promotion via website and social media, as written above
  • Promotion via print (flyers, posters 13 x 19 inches and smaller, etc.)
  • Redistribute a copy of the digital file to a venue/event promoting the musician/band associated with the digital file for the purpose of promoting the musician/band's engagement  at said venue/event



Prohibited Uses

The Customer may not:

  • Resell, relicense, sub-license, or redistribute in any other fashion than described above without express written consent by The Nightmare & The Nightbird
  • Use the media in a pornographic, obscene, illegal, immoral, libelous, or defamatory manner
  • Incorporate the media into trademarks, logos, or service marks without express written consent by The Nightmare & The Nightbird
  • Use the media for wide-format printing promotions (posters greater than 36 inches, billboards, etc.) without express written consent from The Nightmare & The Nightbird
  • Use the media in any posters (printed on paper, canvas, or any other media) or other items (t-shirts, bags, buttons, flyers, stickers, etc.) for resale, license, or other distribution for profit without express consent from The Nightmare & The Nightbird
  • Make the media available for download


Neither The Nightmare & The Nightbird nor its vendors will be liable for any third-party claims or incidental, consequential, or other damages arising out of this license or Customer's use of the media.

All images are property of The Nightmare & The Nightbird and are copyrighted by law. None of them may be copied, used, or published for commercial purposes without The Nightmare & The Nightbird’s clear permission to do so.
